Terms & Conditions of Sale

Entry Forms

Entry forms to be returned to the offices of Morris Bricknell, Stroud House, 30 Gloucester Road, Ross-on-Wye, Herefordshire HR9 5LE NO LATER THAN 1 WEEK PRIOR TO THE SALE DATE to assist with advertising.

Terms of Sale

Commission of up to 15% plus VAT at the current rate of 20% on sale proceeds.  We reserve the right to refuse entry of any items for any reason. MINIMUM CHARGE OF £1 PER ITEM.


Upon receipt of payments all payments are deposited in our Barclays Bank Client’s Account No. 10918385.  This account is interest bearing the interest being retained to offset bank charges. Payments are made once any cheques have been cleared and cheques will be posted within 10 working days of the completion of the sale.

N.B.  Any payments less than £5 after deductions will not be paid by cheque but can be collected from this office as cash or donated to charity.


Transport and storage can be arranged through the Auctioneers and a separate charge will be made for this service.

Unsold Items

These are to be removed immediately after the Auction on the same day.  Those not removed will be sold at the next Auction without reserve.  The right is reserved to charge for removal and disposal of un-saleable items.


Vendors may place reserves upon items entered if they wish and the Auctioneer can assist if required.  The minimum reserve is £5.00.

Electrical Items

Under the Low Voltage Electrical Equipment (Safety) Regulations 1989, electrical items submitted for auction must either be sold as tested by a suitably qualified electrician or sold as scrap and clearly labelled as such with the lead removed.  Genuine antique and collectors items can be sold “for display purposes only” and the leads and plugs removed.  A Qualified Electrician will test all electrical items entered prior to the auction and a charge of £2.00 plus V.A.T. will be made for each item this being deductible from the sale proceeds.

Upholstered Items

Under the Furniture and Furnishings (Fire) (Safety) Regulations 1988, all second-hand furniture which is offered for sale must meet the full fire resistance requirements and must have a permanent label attached.  The only exemption from these Regulations is for furniture made before 1950.  We will therefore be unable to offer any upholstered furniture made after 1950 that does not have the necessary fire regulations label with batch number attached.


On no account will the Auctioneers accept poor quality or un-saleable lots whether enumerated on the entry form or not.  The Auctioneers reserve the right to refuse to sell any such items and any extra cost incurred in their disposal will be charged to the Vendor’s account.

Delivery of Items

All items to be delivered to The Memorial Hall, Whitchurch BETWEEN 9.00 a.m. and 1.00 p.m. the day before the sale date.


Morris Bricknell will not guarantee the condition of any items unless a vendor specifically requests them to do so.  If within 10 days after the sale Morris Bricknell has received from the Purchaser of any lot notice in writing that in his or her view the item is a deliberate forgery and within 7 days of such notification the buyer returns the lot to the Auctioneers in the same condition as at the time of the sale and by producing evidence (the burden of proof to be on the purchaser) satisfying the Auctioneers, that in the light of an entry the lot is a deliberate forgery then the sale of the lot will be rescinded and the purchase price of the same refunded.

The Sale is conducted under General Conditions of Sale, copies of which are available upon request.
